At some point during any claim, the insurance company is going to call you for details about what happened. How much do you share? What if you say something wrong? It can be very confusing, which is why you should consult with an attorney early in the process. Every insurance policy has certain exclusions which could void coverage. Your own insurance company owes you a fiduciary duty in how they are to treat you, which means they have to consider your best interest. The other driver’s insurance does not owe you this duty.

That being said, if you do not have an attorney working for you, you have to be extremely cautious when talking to an insurance company. Most statements after a wreck, even if you are not at fault, will be used against you to minimize your claim or force you to bare some of the responsibilities for your injuries. Anything positive you would say about your claim, or that you think “proves your case,” will often not be admissible. It would only be the parts of your statement where you said something like: “It came out of nowhere” or “I couldn’t see very well” where they would try to exploit you to justify their offer. 

It can get complicated, which is why we always recommend hiring an attorney for any and all claims in your wreck. At Jones Law Firm, we work with insurance companies all the time and know how to proceed.

There’s also a chance that the other insurance company involved could contact you and request your statement about how the wreck occurred or your injuries. They might make it sound like a quick checkup, but, once again, anything that you did share could be used against you.
